“AmTrust International Underwriters DAC (AIUD) propose de transférer ses activités françaises d’assurance responsabilité civile médicale à Bothnia International Insurance Company Limited, une compagnie d’assurance agréée finlandaise (qui fait partie du groupe Compre) (le « Transfert proposé »). Le transfert proposé n’aura aucun effet sur les conditions générales de la couverture existante des assurés. Le transfert proposé sera mis en œuvre par le biais d’un transfert irlandais d’activités d’assurance en vertu de l’article 13 de la Loi sur les compagnies d’assurance de 1909, de l’article 36 de la Loi sur les assurances de 1989 et de la Règlementation 41 du Règlement de l’Union européenne (Assurance et Réassurance) de 2015. Le 4 juillet 2023, la Haute Cour irlandaise a sanctionné le transfert de portefeuille de l’activité med-mal française des garants d’ AmTrust International Underwriters DAC à Bothnia International Insurance Company Limited. Le transfert de portefeuille est effectif à partir du 14 juillet 2023 à 00h01 et une copie de l’ordonnance du tribunal peut être téléchargée à partir de cette page Web.

“AmTrust International Underwriters DAC (AIUD) is proposing to transfer its French medical malpractice insurance business to Bothnia International Insurance Company Limited, a Finnish authorised insurance company (which is part of the Compre group) (the “Proposed Transfer“). The Proposed Transfer will have no effect on the terms and conditions of policyholders’ existing cover. The Proposed Transfer shall be carried out by means of an Irish insurance business transfer under Section 13 of the of the Assurance Companies Act 1909, Section 36 of the Insurance Act 1989 and Regulation 41 of the European Union (Insurance and Reinsurance) Regulations 2015. The Proposed Transfer will require approval from the Irish High Court (the “Court“). The legal process is explained further in the documentation listed below.

On 4 July 2023, the Irish High Court sanctioned the portfolio transfer of the French med-mal business from AmTrust International Underwriters DAC to Bothnia International Insurance Company Limited. The portfolio transfer is effective from 00.01 on 14 July 2023 and a copy of the court order is available for download from this webpage.
